Lengthiest Written Constitution: Simple Notes

  • World's Lengthiest: The Indian Constitution is the longest written constitution in the world.

  • Written vs. Unwritten Constitutions:

    • Written: Like the American Constitution - rules are written down in a single document.

    • Unwritten: Like the British Constitution - rules are based on customs, traditions, and various laws, not one single document.

    • India's is Written and Very Long!

  • Comprehensive, Elaborate, Detailed: The Indian Constitution is not just long, but also very detailed and covers many things in depth.

  • Structure - Then and Now:

    • Originally (1949):

      • Preamble (Introduction)

      • 395 Articles (main sections) - divided into 22 Parts

      • 8 Schedules (appendices with extra details)

    • Presently (2019):

      • Preamble (same)

      • About 470 Articles (more now) - divided into 25 Parts (more now)

      • 12 Schedules (more now)

    • Changes since 1951 (Amendments):

      • Around 20 Articles deleted.

      • Part VII deleted.

      • About 95 Articles added.

      • 4 new Parts added: IVA, IXA, IXB, XIVA.

      • 4 new Schedules added: 9, 10, 11, 12.

    • No other constitution has so many Articles and Schedules!

  • Why is it so long? Four Main Reasons:

    • Geographical Factors: Vastness and Diversity of India:

      • India is a huge country with many different regions, cultures, religions, and groups of people.

      • The Constitution needed to address the needs and complexities of this vast and diverse nation.

    • Historical Factors: Influence of Government of India Act, 1935:

      • The Government of India Act of 1935 (from British rule) was a very long and detailed law.

      • It served as a blueprint and influenced the framers to create a similarly detailed Indian Constitution.

    • Single Constitution for Centre and States:

      • Unlike some countries (like the USA) with separate constitutions for states and the federal government, India has one single constitution for both the central government and all the state governments.

      • This makes it longer as it has to cover everything for all levels of government.

    • Dominance of Legal Experts in the Constituent Assembly:

      • Many members of the Constituent Assembly were lawyers and legal experts.

      • They tended to go into great detail and make sure every possible point was covered legally, resulting in a longer document.

  • Content - More than Just Principles:

    • Indian Constitution includes not just basic principles of how to govern (like in many constitutions).

    • It also includes detailed administrative provisions - specific rules about how the government should work day-to-day.

    • Things that are usually left to ordinary laws or traditions in other democracies are written directly into the Indian Constitution.

In Simple Words: The Indian Constitution is like the "super-size" version of constitutions! It's the longest written constitution in the world because India is a huge and diverse country, it was influenced by a very detailed old law, it covers both the central and state governments in one document, and it was made by many legal experts who wrote everything down in great detail. It's not just about basic rules, but also about the nitty-gritty of running the government.
